      SMS assists clients in delivering advertising and promotional offers to audiences most likely to be interested in their products or services based on shared characteristics or behaviors.  This includes enabling targeted marketing across multiple channels, including direct mail, social media platforms, and online display advertising.
    • Data Enrichment:
      SMS supplies data to organizations to improve the accuracy, completeness, and value of their own customer and prospect records.  This helps businesses gain deeper insights into their audiences, personalize their outreach, and make more informed business decisions.
    • Analytics and Market Research:
      SMS provides data used to analyze consumer trends, measure campaign effectiveness, assess market opportunities, and support the development of business intelligence.  This helps companies refine their marketing strategies, improve product offerings, and better understand marketplace dynamics.
    • Multi-Channel Marketing Enablement:
      SMS facilitates the delivery of coordinated marketing messages across a variety of channels, including direct mail, email, social media, and online display advertising, to improve reach and engagement with target audiences.
    • Interest-Based and Cross-Context Behavioral Advertising:
    • SMS data may be used by our clients and their partners to deliver interest-based advertising, also known as targeted or cross-context behavioral advertising. This involves using information about consumer characteristics, behaviors, and interests—collected across different websites, applications, and offline sources—to deliver more relevant advertising content.
    • This practice may include:
      • Assisting clients in identifying and reaching audiences based on shared demographics, purchase behaviors, or lifestyle interests.
      • Enabling the delivery of targeted ads across various channels, including websites, mobile apps, social media platforms, and connected devices.
      • Supporting measurement and attribution activities to assess the effectiveness of advertising campaigns and optimize future marketing efforts.
  • When data is used for interest-based advertising, it may involve the use of pseudonymized identifiers (meaning Personally Identifiable Information is replaced with artificial identifiers to help protect personal privacy and improve data security by replacing them with placeholder values), such as hashed email addresses or device IDs, to help match consumer data across different platforms while maintaining reasonable privacy safeguards.
  • SMS may also assist clients by providing data hygiene services to help maintain the accuracy of their marketing databases and support identity resolution efforts, which allow businesses to recognize and engage consumers consistently across different platforms and devices.
 

SMS has also collected “Sensitive Personal Information” over the past twelve (12) months.  “Sensitive Personal Information” has a different definition under the CCPA, the VCPA, the CPA, the UCPA, CTDPA, MTCDPA, DPDPA, NHCPA, NDPA, and the NJDPA.  Under all laws, this type of information requires additional protection.

Sensitive Personal Information that is “publicly available” is generally not considered sensitive personal information or personal information.

The categories of Sensitive Personal Information that SMS collects are as follows:

  • A consumer’s racial or ethnic origin, religious or philosophical beliefs, or union membership.
  • Personal information collected and analyzed concerning a consumer’s health.
 

SMS does not collect Sensitive Personal Information for residents of VA, CO, CT, OR, TX, MT, DE, NH, NE, or NJ.

Right to Know, Access, and Portability

As a resident of CA, VA, CO, UT, CT, OR, TX, MT, DE, NH, NE, NJ or IA resident, you have the right to request that SMS disclose the specific pieces or categories of personal information that we have collected about you in the preceding twelve (12) months.  Click here to submit a verifiable request to exercise this right.

In order for SMS to properly verify the Consumer’s identity prior to any disclosure of information, SMS will require, at a minimum, the Consumer’s full name, address, email address, and telephone number.

Once your identity has been verified, we will provide you with a report of the specific pieces or categories of your personal information SMS possesses in a portable format.

If based on the information you provide SMS cannot verify the identity of the person making the request, SMS may request additional information for verification or deny your request.

SMS is not required to provide information to the same consumer more than twice in a twelve (12) month period.

Right to Know Data Shared

As a resident of CA, VA, CO, UT, CT, OR, TX, MT, DE, NH, NE, NJ, or IA resident, you have the right to request that SMS disclose the categories of your personal information we have disclosed or sold to third parties for a business or commercial purpose in the preceding twelve (12) months.  Click here to submit a verifiable request to exercise this right.

Right to Opt-Out of Sale (and Profiling, and Sharing for Targeting Advertising)

SMS engages in consumer profiling, and depending on your state of residence, you have a right to Opt-Out (ask SMS to not include you in its consumer profiling).

Right to Correct

Right to Appeal

If you are a resident of VA, CO, CT, OR, TX, MT, DE, NH, NE, NJ or IA and we deny your request to exercise your privacy rights, you have the right to appeal our decision.  Should you wish to appeal a determination we have made with regard to your personal information request, you may:

  • Email us at [email protected] within thirty (30) days of receiving a final response from us.
  • Include “DSR Appeal” in the subject line. (DSR stands for Data Subject Request, which includes the rights you have under certain state privacy laws.)
  • Include either a copy of your original request to SMS, or the email or letter from SMS explaining why your request was denied. If you are unable to provide your original request or our response, SMS will make its best efforts to locate the relevant records based on the information you provide.
  • We will review and respond to your appeal within a reasonable timeframe, as required by applicable laws.

Right to Non-Discrimination

You have the right not to receive discriminatory treatment by SMS for exercising your privacy rights.

Data Retention Policy

SMS may store your information for as long as it is required for our business purposes, including those set forth in this Privacy Notice.  SMS regularly deletes information that is deemed unreliable or inaccurate.

Authorized Agent

As a resident of specific states, you can designate an authorized agent to make a request on your (the consumer’s) behalf.  Please check your state’s specific guidelines for properly authorizing an agent.
